In recent years, the systemized campaigns launched by religious and political leaders and media men increased. Such campaigns are against the best one among the creation of Allah, the Prophet of mercy Muhammad, prayers and peace of Allah be upon him. This is not something new for the enemies of the Messengers and the Messages [of Allah]. Rather, it is something old since the creation of mankind. All the Messengers sent by Allah faced mocking and ridiculing from their people. Allah says, {And indeed (many) Messengers before you were mocked at,} [Surat Al-An’âm 6:10]
 
{وَلَقَدِ اسْتُهْزِئَ بِرُسُلٍ مِّن قَبْلِكَ} الأنعام: 10
 
Transliteration: Walaqadi istuhzia birusulin min qablika 
 
What is new now is to attack the personality of the Messenger of Allah, prayers and peace of Allah be upon him, which has become a phenomenon especially in recent times. After the notorious 9/11 attacks, the matter has differed. It has changed from being individual actions or from limited religious masses to a work led by politicians, leaders, (Jewish) rabbis, (Christian) monks, institutions, and systemized Media companies. This coincides with the time when those people call for peaceful coexistence of peoples and mutual respect among communities with different cultures. In addition, they call for putting hatred and fanaticism aside, in addition to spreading other catchy slogans, which deluded many of our brothers.
 
Insolence in this age is somehow similar to what happened at the past. It is divided into two types. The first one is insolence in speech and the second is insolence in actions.
 
 
Firstly, insolence in speech, which is the most widespread, and it is divided into two types:
 
The first is arousing the doubtful matters (in religion).
 
The second is defaming the status of the Prophet, prayers and peace of Allah be upon him, and bringing accusations [against him].
 
- As for the doubtful matters, they are many such as what is aroused about the polygamy of the Prophet, prayers and peace of Allah be upon him. This is in addition to the issues of the freedom of religiousness and the issue of the spread of Islam by sword [violence]…etc. Such doubtful matters are meant to be a way for defaming the Prophet, prayers and peace of Allah be upon him, and transgressing his superior rank. No one of the sons of Adam can reach up to such a rank. Sometimes, they bring about doubts over the fact that the Prophet, prayers and peace of Allah be upon him, had nine wives (at the same time) although the Muslims are not permitted to have more than four wives (at the same time). This doubtful matter is exploited as an insult against him, may my parents be sacrificed for him. Some people say that he is lustful; others say that he oppresses minor girls, and others reject his marriage from a lady who is older than him. They do this without knowing his Prophetic merits which Allah has conferred upon him from among humankind.
 
- Concerning bringing accusations of his honor and fame, there are many events on the western Media level as well as on the Islamic level.

- Insolence against the honor of the Prophet, prayers and peace of Allah be upon him, on the Islamic level is represented in the situation of some of those who do not have faith stabilized in their hearts. In addition, those people do not know the rank of the Prophet, prayers and peace of Allah be upon him, or how to respect him. They defame the honor of his pure wives whose innocence is announced from above seven heavens especially the mother of the believers ‘Aisha, may Allah be pleased with her.
 
On the authority of Hishâm ibn ‘Ammâr, Abu Mohamed ibn Hazam Adh-Dhâhiri said, “I heard Mâlik ibn Anas saying, “Whoever insults Abu Bakr and ‘Umar should be lashed and whoever insults ‘Aisha should be killed.” They asked, “Why is he to be killed for [insulting] ‘Âisha?” He said, “Because Allah Almighty says about ‘Aisha, may Alah be pleased with her, {Allâh forbids you from it and warns you not to repeat the like of it forever, if you are believers.} [Surat An-Nûr 24:17]
 
{يَعِظُكُمُ اللَّـهُ أَن تَعُودُوا لِمِثْلِهِ أَبَدًا إِن كُنتُم مُّؤْمِنِينَ} النور: 17
 
Transliteration: YaAAithukumu Allahu an taAAoodoo limithlihi abadan in kuntum mumineena
 
Abu Mohamed, may Allah have mercy on him, said, “The saying of Mâlik is correct because it is full apostasy and disclaiming the words of Allah Almighty who stressed her innocence.” (Al-Mahallî 13/405) The scholar, Ibn Al-Qayyim, may Allah have mercy on him, said, “The nation has the consensus on the infidelity of her slanderer.” (Zâd Al-Miâd: 1/106)
 
- Another example of mockery is insolence against his blessed Sunnah, prayers and peace of Allah be upon him. This is represented in mocking the beard or the length of the garment, which is in accordance with the Sunnah. This is in addition to mocking other authentic kinds of the blessed Sunnah.
 
Mohamed ibn ‘Uthaymîn, may Allah have mercy on him, said, “Mocking Allah Almighty, His Messenger or the Sunnah of His Messenger is considered infidelity and apostasy where a Muslim gets out from the pale of Islam. Allah Almighty says, {If you ask them (about this), they declare: “We were only talking idly and joking.” Say: “Was it at Allâh (Glorified and Exalted), and His Ayât (proofs, evidence, verses, lessons, signs, revelations) and His Messenger (prayers and peace of Allah be upon him) that you were mocking?”} [Surat At-Tawbah 9:65]
 
{وَلَئِن سَأَلْتَهُمْ لَيَقُولُنَّ إِنَّمَا كُنَّا نَخُوضُ وَنَلْعَبُ ۚ قُلْ أَبِاللَّـهِ وَآيَاتِهِ وَرَسُولِهِ كُنتُمْ تَسْتَهْزِئُونَ} التوبة: 65
 
Transliteration: Walain saaltahum layaqoolunna innamakunna nakhoodu wanalAAabu qul abiAllahi waayatihi warasoolihi kuntum tastahzioona
 
Thus, whoever mocks Allah Almighty, His Messenger, prayers and peace of Allah be upon him, or the religion of the Messenger of Allah, prayers and peace of Allah be upon him, will be an apostate disbeliever who should turn to Allah in repentance. - Another example of defaming the reputation of the Prophet, prayers and peace of Allah be upon him, on the western Media level is what is popular in some websites concerning what is published by the weekly American Huston press in Texas. The newspaper published an advertisement of an American cinema previewing a sex film titled, “the Sex life of Prophet Muhammad, prayers and peace of Allah be upon him.”
 
 
Secondly, insolence in actions
 
This kind is represented in the various trials for writing the novels that mocks his superior rank such as the caricature which appeared in Denmark. Such caricatures caused massive outrage in Islamic countries for the sake of their Noble Prophet.
 
Is there any excuse of ignorance for the one who insults the Messenger of Allah, prayers and peace of Allah be upon him?
 
Sheikh of Islam Abu Al-’Abbâs, may Allah have mercy on him, said, “Insulting is of two kinds; supplication and statement. As for supplication, it is as saying “no peace or blessings be upon him” or “may not Allah elevate his rank”. If a Muslim or a covenanter said such insults, the Muslim should be killed in all cases. However, the Dhimmi (people of other religions who live in the Muslim land) should be killed if he showed this in public.
 
The second kind is the statement and its ruling is that whatever people consider as insults or defamation obligates killing. This is according to the opinion of the companions and scholars. Whatever people do not consider as insult, it is not an insult.” (As-Sârim Al-Maslûl: 1/540)
 
Imam ibn Bâz, may Allah have mercy on him, said, “Whoever lives among the Muslims has no excuse of ignorance in such matters. This is because insulting the religion and abandoning prayer are considered apostasy of Islam. In addition, mocking Allah or His Messenger is apostasy, which does not give an excuse of ignorance among Muslims. This is because it is something known among Muslims and he must necessarily know it as he is staying among Muslims.” (ibn Bâz website)
 
Ibn ‘Uthaymîn, may Allah have mercy on him, said, “As for the one who insulted the Messenger of Allah, prayers and peace of Allah be upon him, he should be killed anyway as he is an apostate disbeliever. In addition, Hanbalis say that his repentance is not accepted because he committed a great sin. However, if he repented, his conditions were reformed, and we saw that he glorified the Messenger of Allah, prayers and peace of Allah be upon him, and his religion, do we accept his repentance, and thus, he is not to be killed? Or do we accept his repentance and he is to be killed?
 
The second opinion is the correct one which is that his repentance is accepted and he will be considered a Muslim but he should be killed. If someone asked, “How do you kill him although you believe that if he insulted Allah, Exalted and Glorified, he will not be killed? Is the right of the Messenger of Allah, prayers and peace of Allah be upon him, greater than the right of Allah?
 
The answer is no. There is no doubt that the right of Allah is greater; however, Allah has told us that He accepts repentance from the one who repents and this is His right. If Allah accepted the repentance of that slave and forgave him for His right, the matter is up to Him.
 
Nevertheless, if someone insulted the Messenger of Allah, prayers and peace of Allah be upon him, he would defame him and the right would be for him, prayers and peace of Allah be upon him. As we do not know if the Messenger, prayers and peace of Allah be upon him, forgave him or not, we should take revenge and kill him. However, if we knew that he is a true repentant, we deal with him as a Muslim. Therefore, we should wash him, shroud him, perform funeral payer of him and bury him with the Muslims.” (The Meeting of the open door)
 
The punishment of the one who insults Allah and the Prophet, prayers and peace of Allah be upon him, according to the Kuwaiti law
 
The Kuwaiti National Assembly unanimously agreed on intensifying the punishment of the one who abuses Allah or His Messenger, prayers and peace of Allah be upon him. Article no. 1 of the law stipulates that: “The one who utters insults in public or in a place where people can hear or see him will be sentenced to death or life imprisonment. This is his punishment if the insult was in the form of speech, writing, drawing or any other means of expression. Such expression may be concerning Allah, the Holy Quran, the Prophets, the Messengers, or Prophet Muhammad, prayers and peace of Allah be upon him. In addition, it may be concerning his honor and the honor of his wives. The punishment will be applied after the trials of the judge to oblige him to repent if he insisted on his sin without repentance. Moreover, the same punishment is ascribed for the one who alleges prophecy.”
